Co-operative fined £30k for supermarket asbestos exposure

Customers and staff at a supermarket in Oldham were exposed to asbestos when a workman smashed a ceiling panel containing the hazardous substance.

Asbestos SurveysIn December 2007, SF Fire Protection Services Ltd was contracted to install a new fire alarm at a Co-operative store in Market Square, Royton. During the work an engineer broke a ceiling panel in order to fit a cable to the alarm. The worker was unaware that the panel contained brown asbestos and the debris fell on to the shop floor. Two of the store’s employees helped clear the debris and left it in an open bag at the rear of the store for two weeks.

Three months later Oldham Council received a waiver application from a separate contractor who was carrying out unrelated work at the store. The waiver allows asbestos work to be carried out without the required 14 days prior notification. An environmental health officer visited the store to consider the application and found traces of asbestos on top of a food cabinet and inside a freezer. It was at this point when he was informed about the incident during the installation of the fire alarm.

Company owner fined for asbestos training failings

The owner of a refurbishment company has appeared in front of magistrates for failing to provide employees with asbestos awareness training.

Neil Brown, trading as High View Services, was contracted by North Tyneside Council to make repairs during the refurbishment of a council house in Killingworth in January 2009. An upgraded heating system had been installed at the property and Brown’s firm was repairing surfaces that had been damaged during the installation.

On 6 January 2009, a council employee identified asbestos materials in debris, which had been placed in a wheelie bin outside the property. The HSE was notified and its investigation found that Brown had failed to provide asbestos awareness training for any of his employees who were working inside the property.

Asbestos Training

The Control of Asbestos Regulations 2006 in the form of Regulation 10 include a wide range of requirements for asbestos training. This training in tiered in terms of content and duration and the regulations cover a wide range of groups.  Importantly the training needs to be delivered by a competent person.  The requirements have identified 3 types of training aimed at clear groups.

Asbestos Awareness Training

This for those who may encounter asbestos as part of the work they undertake. Target groups include, plumbers, electricians, carpenters, other tradesman, caretakers, telephone and computer engineers also building professionals, such as architects and surveyors.

Non–Licensed Asbestos Training.

This training is specifically aimed at those who undertake work with non-licensed asbestos materials and should incorporate an element of practical training.

Licensed Asbestos Removal Training

This training is specifically aimed at those who work within the asbestos industry undertaking the removal of higher risk materials.

In addition to the requirements of Regulation 10 additional training is required for those who work as asbestos surveyors and analysts, and where necessary specialist training is also required for those who may find themselves with Duty Holder responsibilities.
